What is WANTONNESS and why should you care?

A recent decision by the Alabama Court of Civil Appeals held that the statute of limitation for wantonness is six years, rather than two years, as has been previously held. This decision will affect how and when legal claims can be presented, and knowing the law is knowing your rights.


In the case of Walker v. Capstone Building Corp., the Alabama Court of Civil Appeals decided that a claim for wantonness is based on personal injury caused by an intentional act of a defendant. The nature of intentional acts are such that they warrant the application of a six year statute of limitations, rather than the previously applied two year statute of limitations.
